ACKNOWLEDGEMENT AND VOLUNTARY ASSUMPTION OF INHERENT RISK

I acknowledge that participation in recreational activities at the Facility involves inherent risks that cannot be entirely eliminated regardless of the care taken by BOUNCERZ REGINA INC. I understand that these inherent risks include, but are not limited to:

(a)  slips, trips, and falls on or around inflatable structures;

(b)  collisions with other participants, walls, floors, or equipment;

(c)  failure or deflation of inflatable equipment;

(d)  sprains, strains, fractures, dislocations, concussions, or other physical injury;

(e)  injuries resulting from failure to follow posted rules or staff instructions;

(f)   aggravation of pre-existing medical conditions; and

(g)  in rare cases, catastrophic injury, paralysis, or death.

WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to enter and use the Facility, I hereby waive, release, and forever discharge BOUNCERZ REGINA INC from any and all claims, demands, actions, causes of action, and liability for any loss, damage, injury, or death that may arise from my participation at the Facility, including, without limitation, any claim arising from the negligence of BOUNCERSZ REGINA INC.

LIMITATION ON SCOPE OF RELEASE

Nothing in this document shall be construed as a release or waiver of liability for loss, injury, or death caused by the gross negligence or willful misconduct of BOUNCERZ REGINA INC, or for any liability that cannot lawfully be excluded or limited under the laws of Saskatchewan, including any non-excludable obligations arising under The Occupiers’ Liability Act, S.S. 1978-79, c. O-1.

INDEMNIFICATION

RULES AND SAFETY COMPLIANCE

I agree to abide by all posted rules, signage, and instructions provided by BOUNCERZ REGINA INC staff, including:

(a)  no food, drinks, or gum in bounce areas;

(b)  no flips, roughhousing, or unsafe behaviour;

(c)  compliance with all height, weight, and age restrictions for specific equipment;

(d)  children under the age of 7 must be accompanied and actively supervised by an adult at all times; and

(e)  compliance with all instructions from Bouncerz staff regarding safe use of equipment.

BOUNCERZ REGINA INC reserves the right to remove any participant who fails to comply with facility rules, without refund.

PHOTO AND VIDEO RELEASE (OPTIONAL)

BOUNCERZ REGINA INC may photograph or record video of participants for marketing and promotional purposes. Please indicate your preference:

If neither box is checked, BOUNCERZ REGINA INC will treat this as non-consent.

PARENT OR LEGAL GUARDIAN ACKNOWLEDGEMENT

Complete this section only if the Participant is under 18 years of age.

I, the undersigned parent or legal guardian, confirm that I have read and understood this entire document. By signing below:

(a) I consent to the minor Participant’s participation in activities at the Facility;

(b) I accept responsibility for the minor Participant’s safety and supervision while at the Facility;

(c) I waive, on my own behalf, any claims I may personally have against BOUNCERZ REGINA INC for loss, injury, or damage arising from the minor Participant’s activities at the Facility, including claims for loss of care, guidance, and companionship, and for expenses I may incur as a result of injury to the minor Participant; and

(d) I acknowledge that this waiver applies to my own claims only and does not purport to waive or release any independent cause of action that the minor Participant may have in their own right.

GENERAL PROVISIONS

Severability. If any provision of this document is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Governing Law. This document shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Saskatchewan.

Entire Agreement. This document constitutes the entire agreement between the Participant (and, where applicable, the parent or legal guardian) and BOUNCERZ REGINA INC with respect to the matters addressed herein, and supersedes all prior discussions, representations, or agreements relating to the same subject matter.

Acknowledgement of Opportunity to Obtain Legal Advice. I confirm that I have been given a reasonable opportunity to read this document in its entirety, to ask questions, and to obtain independent legal advice prior to signing. I am signing this document voluntarily and with full knowledge of its contents and legal consequences.

IMPORTANT LEGAL NOTICE

BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE BOUNCERZ REGINA INC FOR NEGLIGENCE. THIS DOCUMENT IS BINDING. PLEASE READ IT CAREFULLY BEFORE SIGNING.
